1. Introduction

1.1. When creating a user profile (“profile”), you are entering into a legal agreement with us about the use of our services on the Trendsales platform.

1.2. To administrate your profile while offering our services in compliance with the agreement, we need to process your personal data. We process your personal data pursuant to the GDPR, article 6 (1)(b) to fulfill an agreement with you as registered.

1.3. This Privacy Policy accounts for how we process and store your data.

2. Member Discretion

2.1. It is our aim to safeguard the personal data of all our users best possible. Therefore, we have a member discretion policy, which implies that you cannot use or share information about other users obtained through the Trendsales platform or given to you by Trendsales or by other users. Information obtained through Trendsales can only be used for purposes of entering into or completing trades.

3. Platform versions

3.1. We offer both an app version, a desktop version and a mobile web version of our platform. Due to the technical structure and development of these, certain features may be limited between versions.

4. Creation of a profile

4.1. When creating your profile, you must sign up with either Facebook, your mail account or Apple ID.

4.2. When logging in via Apple ID, your Apple ID is used to create you as a user on our platform. When you use Apple ID as a login, Apple makes sure to verify your details and that you are the one using the feature. We receive confirmation of your details by using a range of technical and pseudonymised information. This means that we will not gain access to specific personal data about you from Apple, but to prevent fraudulent access to our platform, your identity will be confirmed with technical data from Apple. Neither we nor Apple will share any further information. The reasoning behind using Apple ID as a login, is to protect your privacy and an accessible way to get started. You can choose to inform us about the name and email address associated with your Apple ID, but you do not have to do so. If you choose to provide us with your personal data, we will of course treat it confidentially and with discretion in compliance with this Privacy Policy.

4.4. When signing up with Facebook, the login from you Facebook profile is utilized to create your profile on our platform.

If you sign up or log in with Facebook, we collect, store and use your Facebook data in compliance with your privacy settings on Facebook and this Privacy Policy. Your consent for this is given, when you accept to use your Facebook login to sign up, or when you log in with Facebook. Depending on your Facebook privacy settings, the information that we may be given access to may include the following:

  • Your name
  • Your profile picture
  • Your email address
  • Your gender

If you have agreed to receive marketing material from Trendsales, you will receive emails at the email address associated with your Facebook profile. Please note that you can withdraw your consent at any time, by using the unsubscribe link found at the bottom of the email. In addition, you can set up or change your push notification settings at any time by using your phone, tablet and/or desktop device.

5. Registration of your profile information

5.1. In connection with the creation and ongoing administration of your profile, we process the following information:

  • Profile name: If you enter your real name, including first and last name, please note that this will be shared with other users if you trade via our trading system. Here, your trading partner will be able to see the provided first and last name via the selected shipping provider.
  • Profile picture: You can voluntarily upload a profile picture to your profile.
  • In your profile settings, you can voluntarily enter your phone number, email address, address, postal code, city, bank details and payment card details. You will need this when you need to make a purchase, cf. section 6.

5.2. Our legal basis for processing is GDPR Article 6(1)(b) on processing necessary for the performance of a contract to which the data subject is party or for the implementation of pre-contractual measures taken at the request of the data subject.

6. Trendsales payment system

6.1. To buy and sell on Trendsales, you need to use our secure payment service, which transfers money to and receives money from other Trendsales users in connection with transactions. When you pay, you have the option to pay directly from your credit card (including ApplePay or GooglePay) or through MobilePay. If you sell an item through the payment service, you must provide the registration and account number to which the money is to be transferred. It is only allowed to have money transferred to your own bank account due to the Danish Money Laundering Regulations.

6.2. In order to complete a transaction, we process the following information: email address, phone number, address, postal code, city and profile name. Please note that this information can be shared between buyer and seller.

6.3. For security reasons in connection with the money transaction, we also collect the buyer and seller’s IP address.

6.5. Our legal basis for processing is GDPR Article 6(1)(b) on processing necessary for the performance of a contract to which the data subject is party or for the implementation of pre-contractual measures taken at the request of the data subject.

6.6. We store all information regarding the use of the payment service for 5 years after the transaction has been completed in order to comply with the requirements of the Danish Act on Bookkeeping, the Danish Money Laundering Act and the Danish Payment Act.

7. Verification of your profile activity

7.1. To maintain and strengthen the security and trust on our platform, we need to verify your activities in various contexts. During the verification process, access to selected functions on Trendsales may be restricted. Among other things, this is to prevent fraud and unauthorized use of our service and to ensure that we comply with customer knowledge procedures in accordance with applicable legislation.

7.2. It is only possible to use one unique MitID per user profile. The usage of the Trendsales profile is restricted to the owner of the MitID only. The owner of the MitID in question is liable for compliance with the applicable terms and conditions on Trendsales.

7.3. In connection with the verification, we may collect the following types of personal data, among others:

  • CPR-number (personal identification number) or CVR-number (company number)
  • PID/UUID-number (a unique number that public authorities can use to reference you as a person – received from Nets A/S when you use NemID or MitID)
  • Name, address, city, postal code and birthday (received from the CPR-register)
  • Date of verification

7.4. The specific purposes and basis for processing constitute:

  • Generally ensuring the observance of the age requirement of 13 years, including through a guardian, which is the minimum threshold for creating a profile on a so-called “information society service” (cf. section 6(2) of the Danish Data Protection Act). It is also the age limit for entering into valid legal contracts for the purchase and sale of goods (cf. section 42 of the Danish Act on Guardianship). Our legal basis for processing is GDPR Article 6(1)(f) on legitimate interest. Our legitimate interest in checking your age is because we have a natural interest in protecting ourselves and our users on the platform from entering into invalid contracts.
  • Creating credit agreements. If you want a credit agreement (also known as a partial payment), you must be at least 18 years old. This follows from sections 1 and 42(2) of the Danish Guardianship Act. Our legal basis for processing is GDPR Article 6(1)(b) on the entering into a valid contract between us and you or you and the creditor.
  • Use of the Trendsales payment system. When you use our payment system, we act as a payment service and are obliged to verify the seller of an item based on the requirements for KYC-procedures in chapter 3 of the Danish Money Laundering Act. Our legal basis for processing is GDPR article 6(1)(c) about processing operations necessary for fulfilling legal requirements.

8. Location Service

8.1. Our platform offers certain features based on a location service, such as showing you the nearest parcel shops, etc. You can choose to turn location services on and off via your device’s settings at any time.

8.2. Our legal basis for processing is GDPR Article 6(1)(a) on processing based on consent.

9. Profile Data

9.1. In relation to your ongoing use of our service, we process all information for your profile as this is necessary to provide and improve our service (“Profile Data”).

9.2. Profile data includes the following that we automatically record:

  • All created listings including data of the listings
  • All trades and transactions
  • Saved favorites
  • Boosters
  • All views of the listings
  • Private messages
  • Who you follow
  • A presumption of your gender, generated based on your first name if you have not otherwise informed us of your gender. This is used to automatically personalize the feed you are presented with on the platform.
  • Preferences on e.g. categories, brands and sizes, if you have used the “Tune with Trendsales” function
  • Technical data (including IP address, Device ID and connection information)
  • Other profile data generated in connection with the use of features on the platform.

9.3. As secondary purposes, we process profile data if we are required to do so by law, for security reasons, or to protect our interests in case of a dispute. An example of such extraordinary use of data is the prevention of fraud, sale of counterfeit goods and other illegal activity. Our processing basis for this is GDPR Article 6(1)(f) on our legitimate interest, which does not generally override the protection of your personal rights.

9.4. Remember that you are responsible for the risk of publishing your personal information in listing descriptions and private messages on the platform. To ensure your safety on the platform and to make continuous improvements, your private messages and listings may be monitored by relevant employees.

10. Listings

10.1. To help with creating your listings, we ask you to fill in a range of information about the characteristics of the item for sale, including uploading media to your listing.

10.2. Before uploading media, please pay special attention to the following:

  • You are responsible for securing the copyright of the media
  • You are responsible for obtaining consent from people other than yourself if they can be identified in the media. We are not responsible for this.
  • We are entitled to use your uploaded media (not your profile picture) on the Trendsales platform and in other commercial contexts, such as in our newsletters or advertisements.
  • We retain both open and closed ads in our database for up to 5 years in the event that we are ever required to disclose or use them by law, or as part of a dispute or in response to a valid request from a law enforcement or government authority. The time limit is based on the statute of limitations for copyright infringement or similar claims by rights holders.
  • Listings may appear when searching on search engines on the Internet. We are not responsible for this.

11. Reporting obligation to the tax authorities

11.1. As a company that facilitates the sale of goods, Trendsales is subject to an EU directive that came into force in 2023, the so-called Directive of Administrative Cooperation version 7 (DAC7). In concrete terms, this means that we are obliged to report information to the Danish tax authorities if you sell goods above certain amounts or have many sales in a year.

11.2. Our legal basis for processing is GDPR Article 6(1)(c) on processing necessary for compliance with a legal obligation to which we are subject. We refer to section 11(2)(1) of the Danish Data Protection Act, cf. section 28(3) of the Executive Order on platform operators’ reporting obligation regarding sellers and landlords.

11.3. By law, we process the following information for sellers:

  • First and last name
  • Your address
  • CVR or CPR number
  • Registration and account number used for payouts
  • Number of transactions and amounts, cf. current practice from the Danish tax authorities which you can read about here

12. Cardholder Data

12.1. When you choose to buy our services, we ask you for your cardholder data (card number, expiration date, and CVV number). To safely process the transactions, we use a secure third party service.

12.2. We do not store your cardholder information. Instead, these are stored securely with partners who are obligated to store the information under elevated security conditions according to their European bank license. Read more about our safety measures and conditions here

13. Statistics

13.1. All data listed above is used by us in anonymized or pseudomized forms for statistical purposes in order to improve our service. Our basis for this is the GDPR, article 6 (1)(f) on our legitimate interest, which does not in principle exceed the consideration of your personal rights.

14. Marketing on Social Media

14.1. We can use your profile data and profile information to target our content and advertising based on your interests. This is done on our own platform and on social media so that you can receive relevant content from us.

14.2. We process your information in pursuant to our legitimate interest in marketing our services (GDPR article 6(1)(f)). This is not direct marketing as described in section 15, and your information is not used independently by social media. We must inform you that the social media platforms and their potential partners have the possibility, independently of us, to use their own information about you for marketing targeted towards you, if they are entitled to according to their terms and conditions, and if you have given your consent through your privacy settings with the social media platforms or in your internet browser.

15. Newsletters etc.

15.1. We use the email address to send you newsletters and other direct marketing material in accordance with your consent. You can read more about this in our terms and conditions.

15.2. You can withdraw your marketing consent at any given time, and you can change your push notification settings in your own device’s settings.

16. Support

16.1. We offer to help you in our support teams if you have questions or problems with the platform. In this context, we process all the information you provide us within your inquiry, as well as your profile data and profile information to the extent that it is relevant to the case.

16.2. Information from support is stored with a secure third party that provides our support system and is processed for the same period of time as your profile data and profile information.

17. Data Sharing

17.1. We share data with third parties, only if necessary to provide our service. Third parties should be understood as the following:

  • Companies within the Trendsales corporation

  • Secure services within data processing that assist us or the Trendsales corporation with IT or other services

  • Authorities or others in relation to legal demands and obligations, or for the protection of our legitimate interests in a legal conflict

18. Our Security

18.1. To protect your data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access in accordance with data protection regulations in Denmark and the EU, we store all personal data with our security approved data processors.

18.2. Our data processors are located within the EU or in the USA with companies that have joined the EU-U.S. Privacy Shield Framework, or in countries outside of the European Economic Area (EEA), also known as third countries. In these third countries, our data processors are within companies that process data based on the European Commission’s Standard Contractual Clauses (SCC).

18.3. All our employees are subject to confidentiality and we have limited the access to personal data to not more than strictly necessary.

19. Closure of your profile

19.1. You have the option to request that your profile be closed at any time. You can do this directly in our app or by writing to us at support@trendsales.dk.

19.2. Your personal data will be deleted on an ongoing basis as the retention period according to legislation and purposes expires. The different processing activities are described in sections 4-15 above.

20. Your Rights

20.1. You can always access your information on your profile and edit your information if your address or email has changed. As a user of the platform, you are responsible for ensuring that the information on your profile is correct and valid at all times. You can update your information by using the My Profile / Settings menu or via the trade flows.

20.2. You are also welcome to contact us to gain further insight into the information we process about you, as well as to update, correct, delete or provide information that you cannot manage on your profile. Requests regarding this should be directed in writing to privacy@trendsales.dk.

20.3. Please note that you cannot exercise your rights in cases where the legitimate interests of Trendsales or other parties for continued processing outweigh your privacy interests. For instance, we claim the right to collect debts or investigate fraud.

20.4. If you wish to make a complaint about our use of your data, we ask you to contact us directly. If we are not in a position to help you, you can direct your complaint to your local protection authority, which in this case is the Danish Data Protection Agency.

21. Changes

21.1. We reserve the right to change the Privacy Policy. If there are significant changes, we will inform you via email and/or directly on the platform.
