1. Introduction

1.1. When creating a user profile (“Profile”), you are entering into a legal agreement with us about the use of our services on the Trendsales platform.

1.2. To administrate your profile while offering our services in compliance with the agreement, we need to process your personal data. We process your personal data pursuant to the GDPR, article 6 (1, para b) to fulfill an agreement with you as registered.

1.3. This Privacy Policy accounts for how we treat and store your data.

2. Member Discretion

2.1. It is our wish to safeguard the personal data of all our users best possible. Therefore, we have a member discretion policy, which implies that you cannot use or share information about other users obtained through the Trendsales platform or given to you by Trendsales or by other users. Information obtained through Trendsales can only be used for purposes of entering into or completing trades.

3. Desktop and App

3.1. We offer both a desktop version and an app version of our platform. Due to the technical development of the two versions, some features may be limited on one or the other version.

4. Creation of a profile

4.1. To create your Profile, you must sign up with either Facebook, your mail account or Apple ID.

4.2. Your Apple ID will be used to create your account on our platform if you choose to use your Apple ID when login in. When you use Apple ID as a login, Apple will verify that it is you who is using the function. We will get confirmation that you’re an actual person by using a range of technical and pseudonymized data. This means that we will not get access to specific personal data about you from Apple, but to prevent fraud, your identity will be confirmed with technical data from Apple. Neither we nor Apple will share further information. The reason to use Apple ID as a login, is to protect your privacy and to get started in an accessible way. You can choose to inform us about the name and email that is connected to your Apple id, but you don’t have to. If you choose to give us your personal data, we will of course handle them securely and with discretion in compliance with this privacy policy.

4.4. When signing up with Facebook, the login from you Facebook profile is utilized to create your profile on our platform.

If you sign up or log in with Facebook, we collect, store and use you Facebook data in compliance with your privacy settings on Facebook and this Privacy Policy. Your consent for this is given, when you accept to use your Facebook login to sign up, or when you log in with Facebook. Depending on your Facebook privacy settings, the information that we may be given access to may include the following:

  • Your name

  • Your profile picture

  • Your email address

  • Your gender

If you have accepted to receive weekly marketing material from Trendsales, you’ll receive emails on the email address connected to you Facebook profile. You can unsubscribe to the email at any time where the unsubscribe link is found at the bottom of the email, and you will be able to change your settings of emails and push-messages on your phone and/or tablet or desktop device.

5. Registration of your Profile Information

5.1. When creating your profile, we ask you for the following (“User information”):

  • Name: Our services is amongst other build on safety and trust between buyer and seller. Therefore, the agreement with us requires your real name.

  • Profile picture: To ensure the credibility of your profile and our service, we ask you to upload a profile picture of yourself.

  • In your profile settings, you can choose to ad your address, zip code, town, date of birth, bank account information and credit card information.

5.2. Our support department can rightfully contact you at any time to ensure that you meet our age criteria of 15 years of age in order to utilize the platform. If you are contacted, you may be asked to provide a relevant identification document. The information you share in relation to this is only used to greenlight you as a user and is not used or stored for other purposes.

5.3. Verification of your identity

5.3.1. In order to maintain and strengthen the security and trust at our platform, we need to verify your identity in various contexts. Among other things, it prevents fraud and unauthorized use of our service e.g., other persons use other people’s Trendsales profiles, or when the user has not reached the required age of 15 years.

5.3.2. The specific purposes and basis for treatments constitute:

Routine control of the required age limit of 15 years. 15 years is the lowest age limit for entering into valid purchase agreements. It follows from § 42 of the Guardianship Act (Værgemålsloven). Our basis for the process is Article 6 (1)(f) of the GDPR about legitimate interests. Our legitimate interest in checking your age is the natural interest in protecting ourselves and our users on the platform from entering into invalid agreements. Creation of credit agreements. If you wish a credit agreement (also called split payment), it requires that you are 18 years old or older. It follows from § 1 and § 42, stk. 2 of the Guardianship Act. Our basis for the process Article 6 (1)(b) of the GDPR about valid agreement between us and the creditor. The use of Trendsales’ trading system. When you use our trading system we act as a payment service and are obliged to verify the seller of an item on the basis of the requirements for costumer knowledge procedures followed in chapter 3 of the Money Laundering act (Hvidvaskloven). Our basis for the process Article 6 (1)(c) of the GDPR about treatments which are necessary to comply with legal requirements.

5.3.3. We use NemID as verification service and at the same time we look up at the CPR register. When you use NemID this is done through a secure solution operated by Nets A/S. We do not get access to receive the personal information entered. Instead, we receive a special number that we can use to verify the connection between your profile at our platform and the transaction in the transaction in question by means of the entry in the CPR register. Otherwise, we will not be able to see if the name of the user is the same as the user of the NemID. Both Nets A/S and the CPR register are independently data controllers for their treatment of your personal data.

5.3.4. The personal data which we process in connection with verification are as follows:

  • PID-number (a unique number that public authorities can use for reference on you as a person – received from Nets A/S through your use of NemID)
  • Name, address, city, postal code and date of birth (received from the CPR register)
  • Verification date

6. Location Service

6.1. Our platform is build around a location service providing you with a relevant feed on your profile. You can choose to disable the location access at any time through the settings on your device. If you disable location access, our service will not work as intended.

7. Profile Data

7.1. In connection to your continuous use of our service, we process all data related to your profile as necessary to provide and improve our service (“Profile Data”).

7.2. Profile data includes the following information that we automatically register:

  • All created listings, listing information and item locations

  • All trades and transactions

  • All favorites

  • Boosters

  • All item views

  • Comments

  • Private messages

  • Users you follow

  • An assumption of your gender, based on your first name, if you haven’t already informed us of your gender. This is used to automatically personalize the feed you are presented with on the platform.

  • Technical data (including IP address, Device ID and connection information)

  • Other profile data generated in relation to your use of the functions on our platform

7.3. For secondary purposes, we process profile data if we are obligated to by law, for safety reasons or to protect our interests in a potential conflict. An example of a such extraordinary use of information could be to prevent fraud, to prevent the sale of replica items or to prevent other illegal activity. Our basis for this is the GDPR, article 6 (1, para f) on our legitimate interest, which does not in principle exceed the consideration of your personal rights.

7.4. Please remember that you are solely responsible for the risks associated with sharing your personal information in comments, private messages and publicly on the platform. For security and improvement purposes, your private messages can be monitored by appropriate employees.

8. Listings

8.1. For the creation of your listings, we ask you to fill out information about the item’s properties, including photos that you can upload to your listing.

8.2. Before you upload a photo, we kindly ask you to be aware of the following:

  • You are responsible for ensuring the proper usage of the photos according to copyright law.

  • You are responsible for collecting consent from others than yourself that appear on a photo. We are not responsible for this.

  • We are legally entitled to use your uploaded photos (except your profile picture) on the Trendsales platform and for other commercial purposes - e.g. for newsletters or advertisements.

  • We store active listings until they are closed. After this, they are saved in our database for up to 5 years, in case we are compelled to provide or use them by law, in relation to a conflict or as a response to a valid request from a law enforcing or public authority. This limit is based on the statute of limitation on claims from owners of copyright material in relation to copyright infringement or similar issues.

  • Listings may appear on search engine results online. We are not responsible for this.

9. Trendsales payment system

9.1. We offer a payment solution for you to use, which enables you to transfer and receive money to and from other Trendsales users. When you make a payment, the amount can either be withdrawn directly from your card or through Mobilepay. When receiving payments for items sold through the solution, you will be required to inform us of your account- and registration number of your bank account. It is only allowed to receive payments on your own account due to anti-money laundry regulation.

9.2. In order to deliver the solution, we process your user information and the information from your listings in relation to trades. For safety reasons, we also collect the IP addresses of both the seller and the buyer when processing monetary transactions.

9.3. We ask you to be aware that your user information are shared with the buyers and/or sellers that you trade with. Other information is not available to be accessed by others than Trendsales ApS.

9.5. We store all data concerning the solution for 5 years after the completion of the transactions as we are obligated too according to the danish acts on bookkeeping, anti-money laundry and payments.

10. Cardholder Data

10.1. When you choose to buy our services, we ask you for your cardholder data (card number, expiration date, and CVV number). To safely process the transactions, we use a secure third party service.

10.2. We do not store your cardholder information. Instead, these are stored securely with partners who are obligated to store the information under elevated security conditions according to their European bank license. To read more about our safety measures and conditions, click here

10.3. Your cardholder information is stored by the third party for as long as allowed or obligated to by law. To read more about our partners, click here and here.

11. Statistics

11.1. All data listed above is used by us in anonymized or pseudomized forms for statistical purposes in order to improve our service. Our basis for this is the GDPR, article 6 (1, para f) on our legitimate interest, which does not in principle exceed the consideration of your personal rights.

12. Marketing on Social Media

12.1. We use your profile data, email, and user information to target our content and advertising to your interests. This happens on our own platform as well as on social media, so you can receive relevant marketing material. On social media it is only your e-mail that is used in an encrypted form. We process your information in pursuant to our legitimate interest in marketing our services (GDPR par. 6(1)(f)). This is not direct marketing as described in paragraph 13, and your information is not used independently by social media. We must inform you that the social media platforms and their potential partners have the possibility, independently of us, to use their own information about you for marketing targeted towards you, if they are entitled to according to their terms and conditions, and if you have given your consent through your privacy settings with the social media platforms or in your internet browser.

13. Newsletters etc.

13.1. We use your email address to send you newsletters and other direct marketing material, if you have given us your consent to do so. To read more about this, go to our terms and conditions.

13.2. You are free to withdraw your marketing consent at any given time, and you can stop notifications and push messages to your phone or tablet.

14. Support

14.1. We offer you our support services from our support team, should you have any questions or problems on the platform. In relation to cases in our support department, we process all information given to us by you as well as your user information and your profile data, should it be of relevance.

14.2. Information processed in or given by our support department is safely stored with a third party service that delivers our support system.

15. Data Sharing

15.1. We share data with third parties, only if necessary to provide our service. Third parties should be understood as the following:

  • Companies within the Trendsales corporation

  • Secure services within data processing that assist us or the Trendsales corporation with IT or other services

  • Authorities or others in relation to legal demands and obligations, or for the protection of our legitimate interests in a legal conflict

16. Our Security

16.1. To protect your data against accidental or illegal destruction, loss, changes, unauthorized access or transfer in compliance with the data protection regulations in Denmark and in the EU, we store all personal data with our secure data processing partners.

16.2. Our data processing partners are located within the EU or in the US with companies that have joined the US Privacy Shield agreement. Partners may also be located in third countries with companies that process data in compliance with the standard contractual clauses of the European Commission.

16.3. All our employees are bound by confidentiality, and we have restricted the access to personal data to what is strictly necessary.

17. Closure of Your Profile

17.1. You can ask us to close down your profile at any time. To do so, you can contact us by email at support@trendsales.dk.

17.2. Your user information and profile data are stored for 3 months after the closure of your profile.

17.3. If there are ongoing transactions or support cases on the platform involving your profile, the 3 months are calculated from the closure date of the last open support case.

17.4. Regardless of all information given prior, your profile will not be closed until all ongoing transactions and support cases are finished.

17.5. We must remind you, that your name and the content of your messages are not removed from private messages or comments on listings.

18. Your Rights

18.1. You can always access your information on your profile and edit your information if your address or email has changed. As a user of the platform, you are responsible for having correct and updated information on your profile. To update your information, go to My Profile / Settings.

18.2. You are welcome to contact us for additional information about our processing and storage of your data. You are also welcome to contact us to update, edit, delete or request information that you cannot administer yourself on your profile. Requests regarding this should be directed in writing to privacy@trendsales.dk.

18.3. We kindly inform you that you cannot exercise your rights in cases where the rightful interests of Trendsales or other parties in favor of the continued processing of your information exceed your interests in the protection of your personal data. For instance, we claim the right to collect debts or investigate fraud.

18.4. If you wish to make a complaint about our treatment of your data, we ask you to contact us directly. If we are not in a position to help you, you can direct your complaint to the Danish Data Protection Agency.

19. Changes

19.1. We maintain our right to make changes to the Privacy Policy at any time. If the changes made to the Privacy Policy are substantial, we will inform you in an email or directly on the Trendsales platform.
